Reverend Adam Lekhoaba, a presenter at Harvest Fm Radio says he would continue fighting for his rights as a citizen of Lesotho, and insists he would not renounce his South African citizenship as dictated by the laws of this country - REPORTS PUBLIC EYE of 16/03/2007....

I have properties in South Africa and like other many Basotho I know, I also want to enjoy the privileges that Basotho with South African citizenship enjoy,” said Lekhoaba, who has since applied for Lesotho citizenship. In an interview with Public Eye Lekhoaba said he was ready to publicly mention the names of cabinet members and their families who were citizens of Lesotho and yet possessed documents that identified them as citizens of other countries. He said he would do this should the government continue to accuse him of being a citizen of South Africa who is not entitled to rights belonging to Basotho only, adding that some cabinet ministers and their families were citizens of South Africa, Canada and the United States of America. “I dug this out while I was in South Africa a few weeks ago,” he said. Lekhoaba went to South Africa after an order of deportation was issued against him. He is now back in Maseru notwithstanding the fact that the order has not been withdrawn.

The presenter accused the government of turning the issue of his nationality into a political game. “It is a diplomatic issue that needs to be resolved by both governments (SA and Lesotho) in a diplomatic way,” Lekhoaba, who applied for Lesotho citizenship, said. He said if he was to renounce his South African citizenship, it does not need to be him alone. “This has to be a process starting from top government officials to the grassroots levels.” The constitution of Lesotho section 41, under the sub heading- Dual citizenship says: “Any person who upon the attainment of the age of twenty one years, is a citizen of Lesotho and also a citizen of some country other than Lesotho shall cease to be a citizen of Lesotho upon the specific date unless he has renounced his citizenship of that other country, taken the oath of allegiance and, in the case of a person who is a citizen of Lesotho by descent, made registered such declaration of his intentions concerning residence as may be prescribed by parliament.”

Sub section 2a and b say: “A citizen of Lesotho shall cease to be such a citizen if - having attained the age of twenty one years, he otherwise acquires the citizenship of some country other than Lesotho and has not, by the specified date, renounced his citizenship of that other country, taken the oath of allegiance and made and registered such declaration of his intentions concerning residence as may be prescribed.”

This punishes Basotho who live abroad. They cannot enjoy full citizenship rights in their host countries and remain sub-players in many fields. Obviously they cannot enjoy full citizenship as Basotho, as they do not live in Lesotho.

On the other hand, Basotho who feel they need to work elsewhere to earn more money or to progress faster professionally, end up losing their Lesotho citizenship. The other country ends up gaining a brain.

This constitutional article needs to be addressed and revised.

What really gets my goat about this whole saga is the HYPOCRISY!!!! how many Cabinet Ministers and members of their extended families have RSA passports and ID's? do you see them being deported? this is victimisation plain and simple. The authorities are abusing their power with the sole aim of marginalising Rev. Lekhoaba, his freedom of speech, expression and association. This sends a message to any dissenter in Lesotho that such dissent will not be tolerated...we are a few months into the LCD's 3rd 5 year term...is this a taste of things to come? well if we are striving to build a viable democracy that will sustain itself for the next few centuries (before climate change or a Third World War destroys what's left of humanity) then we need to build civil society and this means having a govt. that can stomach people like the good Rev. otherwise if we are striving (intentionally or otherwise) to build a banana republic (or kingdom in our case) then we are well on our way.
